The site is free to access. Internet access and equipment costs remain yours.

We strive to keep the site available at all times, without being able to guarantee it. Access may be interrupted for maintenance, updates, technical incident or force majeure, without notice or compensation. We reserve the right to develop the site, alter its content or suspend access at any time.

3Intellectual property

Every element of the site — text, images, illustrations, logo, visual identity, source code, structure and navigation — is protected by intellectual property law and remains the exclusive property of Modiom Tech or its partners.

Any reproduction, representation, adaptation or exploitation, in whole or in part, by any means and on any medium, is prohibited without our prior written permission. This covers in particular the reuse of our texts, our visuals and the structure of our pages.

The work shown in our portfolio remains the property of the respective clients. It is displayed for reference, with their agreement. The trade marks and logos appearing there belong to their owners.

Quoting an extract for informational purposes remains possible, provided the source is clearly stated and a link to the original page is included.

4Prohibited uses

By using the site, you undertake not to:

• attempt to access non-public parts of the site, its servers or its databases;
• probe, scan or test the vulnerability of the site, nor circumvent its security measures;
• extract all or part of the content by harvesting, scraping or any other means of mass extraction;
• use the forms to send unsolicited advertising, unlawful, abusive or defamatory content, or content infringing the rights of others;
• knowingly transmit a file or link containing malicious software;
• overload the site with an abnormal volume of requests;
• impersonate a third party in a form;
• decompile or disassemble all or part of the site.

We reserve the right to block access to the site for anyone breaching these rules, and to take whatever legal action the seriousness of the facts warrants.

5What you send through the forms

By filling in a form, you warrant that the information provided is accurate and that you are entitled to send it — particularly where it concerns a company's contact details.

You remain responsible for the content of your messages. We reserve the right not to act on a request, without having to give reasons.

6Quote requests and services

A request sent from the site constitutes neither an order nor a contractual commitment, on your part or on ours.

The information presented on the site — service descriptions, portfolio work, timeframes mentioned — is indicative and does not constitute an offer in the legal sense. Only a signed quotation, or a contract concluded between you and Modiom Tech, creates a mutual commitment.

Our services are governed by the particular conditions set out in that quotation or contract, which prevail over this document in the event of any discrepancy.

The response times mentioned on the site are targets we strive to meet, not contractual undertakings.

7Limitation of liability

The information published on the site is provided for guidance. We check it carefully, without being able to guarantee that it is free of error, complete or up to date at every moment. It cannot take the place of professional advice suited to your situation.

We cannot be held liable for:

• any unavailability, slowness or interruption of the site, whatever the cause;
• any damage to your equipment arising from browsing the site;
• any decision you take on the sole basis of information published here;
• the content of third-party sites we link to;
• any use of the site contrary to these terms.

These limitations apply to the extent permitted by law. They do not restrict our liability in cases of gross negligence, wilful misconduct, or personal injury.

8Links to other sites

The site links to outside services, notably WhatsApp, Facebook and Google Maps. These links are offered for your convenience. We exercise no control over those services and their use falls under their own terms.

Linking to modiom.com is free, provided the link does not open in a frame and does not suggest a partnership that does not exist. We may ask for the removal of a link we consider damaging.

9Force majeure

We cannot be held liable for non-performance caused by an event beyond our reasonable control: network or power interruption, failure of a host or operator, cyber attack, natural disaster, or a decision by a public authority.

11Changes to these terms

We may amend these terms at any time. The applicable version is the one published on the site at the time of your visit; its update date appears at the top of the page. We invite you to consult it regularly.

12Governing law and disputes

These terms are governed by Moroccan law, the publishing company being established in Casablanca.

In the event of a dispute, we favour an amicable solution: send your complaint to contact@modiom.com and we undertake to answer it. Failing agreement within thirty days, the dispute shall be brought before the competent courts of Casablanca.
